To maintain the information security, transparency, and legality of the resume and job vacancy posting section of the Foreign Worker News Agency (hereinafter referred to as “FWA”), and to protect the rights of both parties using this service (including foreign national job seekers, employers, and private employment service institutions, hereinafter collectively referred to as “Users”), all Users of this section must carefully read the terms of this FWA Data Posting and Job Seeking/Recruitment Safety Covenant before filling out forms or using this service. When Users submit data or begin using this service, they are deemed to have fully read, understood, and completely agreed to accept all the provisions of these terms.

Article 1: Principle of Good Faith and Guarantee of Legal Identity

  1. Job Seeker Guarantee: Users posting resumes must personally guarantee that the name, nationality, work experience, and contact information provided are the latest and absolutely true information of the User. Job seekers must possess valid “legal residency” and work rights in Taiwan. FWA strictly prohibits missing migrant workers, overstayers, or those holding only tourist visas from illegally posting job-seeking information through this platform. If a User violates the above regulations, the User shall bear all civil and criminal liabilities. Employers and private employment service institutions are also requested to strictly verify the identity of the job-seeking User and whether they possess legal proof of work.

  2. Recruiter Guarantee: Users posting job vacancies must personally guarantee that their company registration or natural person identity is authentic and valid, and that they possess sufficient and legal “recruitment permits” and quotas. The content of the posted job vacancies must not contain any exaggeration, falsification, or concealment of important labor conditions (including but not limited to actual salary, working hours, and leave systems). If a User violates the above regulations, the User shall bear all civil and criminal liabilities. Job seekers are also requested to strictly verify the legal authenticity of the recruiting employer or private employment service institution.

  3. Proxy Posting Guarantee: If the User is an employer or private employment service institution posting job vacancies or migrant worker resumes on behalf of others, they must personally guarantee that they possess the legal business qualifications issued by the Ministry of Labor and are still within the validity period. Furthermore, when posting on behalf of others, they must have obtained the full authorization and explicit consent of both the employer and the foreign national job seeker, and guarantee that they will never use this platform to conduct unauthorized illegal transnational human resources brokerage. If a User violates the above regulations, the User shall bear all civil and criminal liabilities, and FWA will also pursue, prosecute, or report to the police and judicial authorities in accordance with the law, and the User must compensate FWA for its reputation and all damages.

Article 2: Job Vacancy and Resume Filling Specifications and Legal Professional Terminology

  1. Legal Official Terminology: To avoid misunderstanding by job seekers and to comply with relevant regulations, Users such as employers and agencies must accurately use legal official terminology when filling in job categories and labor conditions.

  2. Cross-industry Transfers: If the User’s migrant worker involves cross-industry transfers, they must strictly comply with the relevant transfer regulations of the Ministry of Labor, and must not post job titles or conditions intended to circumvent the regulations.

  3. Language and Translation: Chinese information should be provided as a priority. FWA may use assisted translation for content filled out without Chinese, but the poster must still bear full responsibility for the accuracy of the final public information.

  4. If a User violates the above regulations, the User shall bear all civil and criminal liabilities, and FWA will also pursue, prosecute, or report to the police and judicial authorities in accordance with the law, and the User must compensate FWA for its reputation and all damages.

Article 3: Prohibited Content and Inappropriate Behavior

  1. Prohibited Irrelevant Information: It is strictly prohibited to publish commercial advertisements, direct sales promotions, lending services, Ponzi schemes, or any other form of profit-making behavior unrelated to job seeking and recruitment.

  2. Prohibited Employment Discrimination: Employer or agency Users must not set employment discrimination clauses in job vacancies that violate gender, religion, race, nationality, or marital status.

  3. Prohibited Illegal Demands: It is strictly prohibited for employer or agency Users to demand unreasonable deposits, force the purchase of goods, or make illegal demands such as withholding the Alien Resident Certificate (ARC) and passport without cause in the job description or subsequent contact.

  4. If a User violates the above regulations, the User shall bear all civil and criminal liabilities, and FWA will also pursue, prosecute, or report to the police and judicial authorities in accordance with the law, and the User must compensate FWA for its reputation and all damages.

Article 4: Safety Precautions for Job Seekers

FWA reminds all Users to be highly vigilant when contacting potential employers or agencies and to keep in mind the following job-seeking safety principles:

  1. Three Major Preparations for Interviews:

    • Before the interview, be sure to inform relatives and friends of the interview location and time, or ask a friend to accompany you.

    • Gather and confirm the background information of the prospective employer, company, or agency in advance.

    • Carefully examine whether the job content and salary proposed by the other party are unreasonable.

  2. Seven “Do Not” Principles for Job Seeking:

    • Do not pay any fees of unknown purpose or unreasonable amounts (e.g., training fees, deposits).

    • Do not purchase any products or services promoted by the recruiting party.

    • Do not casually provide personal information to the other party to apply for credit cards or bank accounts.

    • Do not sign any contracts on the spot that you do not understand, do not have a native language translation, or have not been carefully reviewed.

    • Never let important identity documents and belongings, such as the Alien Resident Certificate (ARC) and passport, leave your sight, and do not let the other party withhold them without cause.

    • Do not drink unknown beverages or eat unknown food provided at the interview location.

    • Never engage in any work that is illegal or completely inconsistent with the originally applied position.

Article 5: Recruitment Safety Precautions for Employers and Agencies

FWA reminds all Users to be highly vigilant when contacting job seekers such as migrant workers and to keep in mind the following recruitment attention principles:

  1. Identity Verification: When contacting migrant worker job seekers, employers and recruiting agencies must accurately check the original Alien Resident Certificate (ARC) and relevant permit documents of the job seeker to confirm that they possess legal residency and work status, to avoid facing severe penalties due to mistakenly hiring illegal migrant workers or missing migrant workers.

  2. Legal Transfer Procedures: If it later involves the transfer of employers by the migrant worker job seeker, both labor and management parties as well as the agency must fully comply with legal procedures and reliably carry out legal procedures such as reporting and permit applications.

Article 6: Complaint, Reporting, and Violation Handling Mechanism

  1. If any party (employers, recruiting agencies, or job seekers) finds during the contact process that the other party has fraudulent intentions, provides false identity, charges improper fees, or intends to engage in illegal brokerage activities, they should immediately stop all contact.

  2. In case of the above situations or labor-management disputes, please immediately call the “1955 Labor Counseling and Complaint Hotline”, or file a report with the local police and labor administrative authorities.

  3. Upon discovering violations or illegal activities, please simultaneously notify FWA by email ([email protected]). The FWA platform will cooperate in the verification, immediately take down the violating information, and permanently blacklist the violator. Relevant electronic records will also be provided to law enforcement agencies for investigation in accordance with the law.

  4. If a User violates the above regulations, the User shall bear all civil and criminal liabilities, and FWA will pursue, prosecute, or report to the police and judicial authorities in accordance with the law, and the User must compensate FWA for its reputation and all damages.
