To protect the rights and interests of both parties and ensure the information quality and smooth operation of the “Resume and Job Vacancy Posting Section” (hereinafter referred to as “this Service”) of the Foreign Worker News Agency (hereinafter referred to as “FWA”), users of this Service (including foreign national job seekers, employers, and private employment service institutions, hereinafter collectively referred to as “Users”) are requested to read these FWA Resume and Job Vacancy Posting Section Terms of Service carefully before filling out forms or using this Service. When Users complete data submission or begin using this Service, they are deemed to have fully read, understood, and completely agreed to accept all the provisions of these Terms.
Article 1: Service Purpose and Platform Disclaimer Positioning
Pure Exposure and Information Display: This Service aims to provide a convenient two-way information exchange platform, open for foreign nationals to post job-seeking resumes for free, and for employers with legal qualifications and legal private employment service institutions (hereinafter referred to as “agencies”) to post job vacancy information. This platform serves solely as a “free information exposure channel,” and FWA will absolutely not be involved in any subsequent contact, interviews, condition negotiations, or substantive employment matchmaking behaviors between labor and management. That is, FWA is a third-party exposure channel and is not responsible for actual job-seeking or recruitment behaviors such as matchmaking between the two parties. It merely provides a platform for exchange and exposure without any fee-charging behaviors. Both parties are requested to exercise caution and carefully verify actual interactions in job seeking and recruitment. FWA does not guarantee any losses and liabilities for both job seekers and recruiters.
No Warranty Disclaimer: FWA promises to strive for the stable operation of the website, but does not guarantee the absolute authenticity, accuracy, or completeness of the resume and job vacancy information posted in the section. FWA also does not guarantee that job seekers will necessarily be hired, or that employers will necessarily find suitable talent. Any disputes, damages, or labor-management disputes arising from the contact, interview, or conclusion of a labor contract between the two parties shall be resolved by both parties themselves in accordance with the law, and FWA shall not bear any legal and joint liability for compensation.
Article 2: Administrative Procedures and Legal Formalities
No Agency Services Provided: FWA only provides information posting and does not provide or involve any administrative agency services related to the employment of foreign manpower. Those with such needs should apply on their own through legal means.
Legal Procedures for Migrant Workers Transferring Employers: If the matchmaking between labor and management involves foreign migrant workers transferring employers, the employer, the commissioned legal agency, and the job seeker must all ensure that the transfer process fully complies with the relevant regulations and legal procedures of the Ministry of Labor (including but not limited to legally signing a “tripartite agreement” or “bipartite agreement” for continuous employment). All transfer and reporting procedures must be handled by the employer or the commissioned legal agency themselves, and FWA assumes no responsibility for any administrative procedures.
Obligation of Regulatory Compliance: The employment of foreign nationals in Taiwan must strictly and fully comply with the relevant laws and regulations of the Republic of China. Throughout the entire process of employing or brokering foreign national job seekers, employers and commissioned agencies must ensure that their employer qualifications, recruitment procedures, cross-industry transfer conditions, and the labor contracts signed by both parties fully comply with the Employment Service Act, the Labor Standards Act, and current laws and regulations promulgated by relevant competent authorities such as the Ministry of Labor.
Article 3: Poster Qualifications and Information Authorization
Job Seeker Qualifications: Those posting resumes must be foreign nationals with legal residency status and work rights in Taiwan.
Employer and Agency Qualifications: Employers must be entities, legal persons, or natural persons legally established under the laws of the Republic of China, possessing the legal “employer qualifications” to employ foreign nationals (including but not limited to possessing a valid migrant worker recruitment permit); agencies must be legal private employment service institutions that have obtained approval and permission from the Ministry of Labor, and have not been subject to administrative penalties such as business suspension, revocation of permits, or prohibition from recruiting foreign nationals.
Guarantee of Authorization for Proxy Posting: If an agency or the original employer fills out the form and posts the resume on behalf of the migrant worker, the proxy poster must declare to FWA and personally guarantee that they have obtained the explicit authorization and consent of the data subject. If a dispute arises due to unauthorized posting, the proxy poster shall bear full legal responsibility and related compensation for damages.
Article 4: Job Vacancy Posting Regulations and Professional Terminology
To maintain the professionalism and legality of recruitment information, employers and agencies should comply with the following regulations when posting job vacancies:
Legality of Labor Conditions: All labor conditions stated in the job vacancy, such as working hours, salary, and leave, must fully comply with the provisions of the Labor Standards Act and relevant labor laws and regulations.
Accuracy of Legal Job Titles: To comply with the laws and regulations on the employment of foreign nationals, please use legal official terminology for recruitment job titles. It is strictly prohibited to use vague, outdated, or rule-circumventing job titles to mislead job seekers.
Article 5: Information Review, Posting, and Removal Mechanism
Review Authority: To maintain platform information quality, FWA may review or randomly check all content submitted through Google Forms. If information is found to be obviously inappropriate, incorrect, in violation of regulations, or contains unnecessary sensitive personal data, FWA may directly delete content or refuse to post it. However, FWA’s random checks do not mean that FWA guarantees the completeness or complete accuracy of job-seeking and related information, nor shall FWA bear any related legal responsibility in the event of subsequent disputes.
Posting Period: The standard posting period for each resume and job vacancy is two months (60 days). Upon expiration, the system will automatically remove the information and destroy the form records. If the poster has found a suitable employer or talent in advance, they can write to the FWA official mailbox ([email protected]) at any time to request early removal of the data.
Privacy Compliance: FWA will strictly abide by the Personal Data Protection Act of the Republic of China and other relevant personal data protection laws and regulations.
Article 6: Service Termination and Violation Handling
For public interest purposes such as maintaining public order and good morals and complying with employment service regulations, if a User experiences any of the following situations, FWA reserves the right to directly take measures such as “temporary suspension,” “permanent removal of posted content,” or “refusal to provide service” without prior notice:
Providing false identity information (including but not limited to overstayers using false identities, forging company names, etc.).
Using this platform to engage in profit-making behaviors unrelated to job seeking and recruitment, such as commercial advertisements, direct sales, and lending.
Committing fraud, coercion, charging improper fees to the other party during the contact process, or intending to engage in illegal transnational human resources brokerage activities.
Being reported as illegal by the competent authority, or being reported by others with reasonable suspicion after preliminary verification.
Other inappropriate actions that violate the establishment purpose and mission of FWA, or violate the spirit of mutual information exposure and exchange.
If a User’s violation causes damage to FWA, in addition to prosecuting according to the law to protect its rights and interests, FWA will claim compensation from the perpetrator according to the law and reserve the right to report to the police and labor administrative authorities to pursue subsequent legal responsibilities.
Article 7: System Risk and Disclaimer
The risk of using this Service shall be borne by the User. FWA shall not bear any liability for damages in the event of suspension, interruption, data damage, loss, or tampering of this Service caused by force majeure factors (such as natural disasters, government regulations), computer virus intrusions, hacker attacks, telecommunication line failures, or system maintenance.
Article 8: Terms Amendment and Governing Court
Terms Amendment: FWA reserves the right to amend these Terms of Service at any time. If there are major changes to the Terms, they will be announced on the FWA website without separate individual notice. If Users continue to use this Service after the amendments, they will be deemed to have agreed to accept such changes. FWA reserves the right of final interpretation of all terms.
Applicable Law: The interpretation and application of these Terms are governed by the currently effective laws of the Republic of China.
