Individuals covered by the Labor Standards Act
If an employer terminates a worker before the end of the labor contract he is required to cover the following expenses:
•Severance pay: This is calculated based on number of yearsemployed and must be paid by law.
•Salary settlement: Salary must be paid in full until the last day of work.
Live-in foreign workers
Whether compensation should be paidin addition to salary related costs depends onthe reason the labor contract is terminatedand who is deemed responsible
In both of the above situations, the employer is required to take responsibility for related procedures, based on the wishes of the foreign worker
•Employer transfer: If a worker wishes to continue working in Taiwan,he or she can choose to transfer employers.
•Returning to country of origin: If the foreign worker chooses to return to his or her country of origin, the employer is required to assist with related departure procedures

若被解聘,雇主是否要給付移工相關費用?
適用勞基法者
雇主提前解聘時需支付以下費用:
•資遣費:按照你的工作年限計算,需依法給付
•結清薪資:應支付截至最後工作日的全部薪資
家事移工
除了應該結清的薪資相關費用外,是否給付賠償費用則視契約終止原因,需歸責對象是誰而定
以上兩者在解聘後,雇主須依移工意願為其辦理相關手續
•轉換雇主:如果希望繼續工作,可選擇辦理轉出程序
•離境:若選擇回國,雇主需協助離境手續
