(FWA 2025/03/20)Waste recycling enterprises or disposal enterprises that have completed permits and registrations in accordance with environmental protection regulations, even without factory registration, may be allowed to apply for employing migrant workers. The Ministry of Environment (MOE) recently convened a consultation meeting on the employer qualificationto gather relevant opinions. Subsequent application procedures can only commence after the Ministry of Labor revises the regulations.

Currently, Waste disposal organizations and waste recycling and disposal enterprises with factory registration can apply for migrant workers. However, similar businesses that also involve 3D (dirty, dangerous, difficult) characteristics but lack factory registration are not eligible to apply for migrant workers.

The Ministry of Environment previously conducted a questionnaire survey, estimating that over 600 enterprises would be eligible to apply for migrant workers under this potential opening. Calculated at a 20% allocation ratio, this could amount to approximately one thousand migrant workers. However, the actual labor shortage needs vary among businesses. Compared to Waste disposal organizations and enterprises, waste recycling enterprises tend to be smaller in scale, with over half having fewer than five employees.

無須工廠登記但已依環保法規完成許可、登記的廢棄物回收業和處理業者將可開放申請僱用移工。日前環境部已就雇主資格認定作業要點召開研商會,蒐集相關意見,待勞動部修訂法規後,才能展開後續申請作業。

現行已具有工廠登記之公民營廢棄物處理機構、應回收廢棄物回收處理業可申請移工,但工作同樣具有3K特性、無工廠登記的同類業者,則無申請移工資格。

環境部曾進行問卷調查,預估此次開放約6百多家企業將有資格申請移工。以20%核配比率計算,總計可聘僱移工約千人,但各家業者實際缺工需求有別,相較於處理機構和處理業,回收業規模則較小,超過半數以上員工人數在5人以下。
