(FWA 2025/10/27)The Ministry of the Interior (MOI) is currently promoting an amendment to the “Regulations Governing the Recognition and Reduction Standards of Special Reasons in Article 74-1 of the Immigration Act,” which took effect on October 1, 2025, to allow foreign personnel who have overstayed their stay or residency in Taiwan to return home with peace of mind.
According to this new system, any overstaying foreign individual who proactively reports to the National Immigration Agency (NIA) before being apprehended is eligible for a 50% reduction in their fine.
The MOI also emphasizes that those who report themselves must still comply with completing: ① Pay the fine, ② Apply for travel documents, and ③ Depart the country within the time limit. Warning: Those who fail to comply will be subject to the full fine!
The MOI stated the purpose of this system is to encourage overstayers to face the situation bravely and stop hiding, allowing every foreign individual in Taiwan to be properly managed and protected. This amendment adopts a “balanced approach of firmness and flexibility” to consider both security management and human rights protection, making the system clearer and more standardized.
