When changing jobs, migrant workers must note that, according to Taiwan regulations, they must first be given priority for continuous employment by an employer in the same job category for 14 consecutive days. If, starting from the day after registration in the Ministry of Labor’s job transfer system, no employer from the same job category registers to hire within 14 consecutive days, only then may employers in other priority orders proceed with cross-sector employment. If the intended workplace location registered in the transfer system is changed during this period, the 14-day period will be recalculated.

For example, during the transfer period of a foreign family caregiver, if no critical care family employer or general family employer registers within 14 consecutive days, other priority-order employers may hire them.

For migrant workers in manufacturing and other job categories, if no employer from the same category registers within 14 consecutive days during the transfer period, the worker may be hired by employers from other priority orders. However, “critical care” family employers may, within the 14-day priority period, register to hire migrant workers from manufacturing or other job sectors to provide caregiving services.

If a migrant worker does not yet have the qualifications to work as a family caregiver, they must, before applying for an employment permit from the Ministry of Labor, either complete supplementary training courses or finish more than 20 hours of online learning via the “Foreign Family Caregiver Supplementary Training” section of the Foreign Workers’ Rights and Interests website. Once completed, they may be hired by an employer to work as a family caregiver.

移工轉換工作必須留意,依照規定必須連續14日優先由同一工作類別雇主接續聘僱,若經勞動部登錄至轉換系統翌日起連續14日內沒有同一工作業別雇主登記承接,才可以由其他順位雇主辦理跨業承接。期間若有變更登錄轉換系統之預定工作地點,14日重新計算。

舉例來說,外籍家庭看護工轉換期間,若連續14日未有重症家庭雇主或一般案家庭雇主登記,才可由其他順位雇主承接。

製造業等其他工作業別的移工,轉換期間若連續14日未有同一工作業別雇主登記承接,移工才可以由其他順位雇主承接。不過「重症」家庭雇主可以在連續14日內,優先登記承接製造業等其他工作業別移工來從事照顧工作。

移工如尚未具備從事家庭看護工作資格時,應在向勞動部申請聘僱許可前,取得補充訓練課程、或於外國人勞動權益網-「外籍家庭看護工補充訓練專區」完成20小時以上數位學習課程,就可以由雇主接續聘僱從事家庭看護工作。
