(FWA 2025/05/19)The National Development Council (NDC) in Taiwan has proposed amendments to the Act for the Recruitment and Employment of Foreign Professionals. These revisions primarily aim to broaden the scope of eligible individuals. This includes graduates from the world’s top 200 universities and allows overseas Chinese students and foreign students who graduated in Taiwan to work without a permit during a two-year job-seeking period.

The NDC explained that some overseas Chinese and foreign students might have other plans during this period, such as training or internships, and may not immediately enter the workforce. Currently, they are unable to take on short-term, part-time jobs during their job search. The relaxed rules will now allow these students to work freely without needing a permit.

For digital nomads, the total permitted stay will be extended to a maximum of two years after the amendments.

Conditions for obtaining permanent residency are also expected to be significantly relaxed. In the future, global elite talent earning over NT$6 million annually can apply for permanent residency after just one year of work.

To enhance social security, the amendments expand the coverage of the New Labor Pension System. All employed foreign professionals will now be included, allowing their years of service and pension contributions to accumulate based on their time working in Taiwan.

The NDC also noted that from May 21st to the end of August this year, at least seven “Talent Taiwan” global online briefing sessions are planned. These sessions will cover topics like Taiwan’s industry opportunities, corporate job vacancies, and digital nomadism. The primary target audience for these events includes international talent and alumni who have graduated in Taiwan. 臺灣國發會(National Development Council, NDC)已提出外國專業人才延攬及僱用法(Act for the Recruitment and Employment of Foreign Professionals)草案,此次修法重點為擴大適用對象,包括國外前200大頂尖大學畢業生,開放畢業僑外生(overseas Chinese or foreign students graduated in the ROC)2年尋職期工作免許可等。

國發會表示,考量有些僑外生這段期間還有其他規劃,例如受訓或實習,未必會馬上投入職場,目前尋職期間無法從事短期部分工時工作,此次也放寬讓僑外生可自由工作,不用申請許可。

數位遊牧方面,修法後總停留期限將延長至最多2年。

取得永久居留資格條件,預期也將大幅鬆綁,未來針對年薪600萬元以上全球菁英人才,工作一年即可申請永居。

為強化社會保障,這次修法擴大勞退新制(New Labor Pension System)適用對象,將所有受聘僱從事工作的外籍專業人員(foreign professionals)都納入,讓年資及退休金可以隨來臺工作時間累積。

國發會提到,今年預計5月21日起至8月底至少辦理七場Talent Taiwan全球線上說明會,主題包括臺灣產業機會及企業職缺、數位遊牧,以國際人才、來臺畢業校友為主要邀請對象。各場次時間可至官網(https://talent.nat.gov.tw/ )查詢。
