This Privacy Protection Policy (hereinafter referred to as “this Policy”) aims to explain the policies adopted by the Foreign Worker News Agency (hereinafter referred to as “FWA”) regarding the collection, processing, utilization, and protection of personal data and corporate information of users, including foreign national job seekers, employers, and private employment service institutions (hereinafter collectively referred to as “Users”), when providing the “Resume and Job Vacancy Posting Section” (hereinafter referred to as “this Section”) services. FWA absolutely respects and is committed to the protection of privacy and personal data. Please read this Protection Policy carefully before filling out forms or using this service. When Users complete data submission or start using this service, they are deemed to have fully read, understood, and completely agreed to accept all the provisions of this Policy.
Article 1: Scope of Application of the Privacy Statement
Applicable Subjects: This Policy applies to all Users who fill out data, apply to post resumes or job vacancies through the exclusive Google Form of this Section, and browse the information in this Section.
Scope of Application: This Policy only applies to the webpages and backend form systems of this Section directly operated and managed by FWA. This Section may contain external links provided by Users themselves, or links to third-party websites of potential employers or agencies. Such external websites have their own exclusive privacy policies, which are not associated with FWA, and FWA shall not bear any joint liability.
Article 2: Purpose and Categories of Data Collection
Purpose of Collection: FWA collects User data for specific purposes limited to: providing “free public posting of resume and job vacancy information,” serving as a simple “channel for information exposure and display,” conducting “platform service quality maintenance and internal management,” and “facilitating initial direct contact between potential labor and management parties or agencies.” FWA does not engage in any substantive employment matchmaking, recommendation, or agency business. That is, FWA is a third-party exposure channel and is not responsible for actual job-seeking or recruitment behaviors such as matchmaking between the two parties. It merely provides a platform for exchange and exposure without any fee-charging behaviors. Both parties are requested to exercise caution and carefully verify actual interactions in job seeking and recruitment. FWA does not guarantee any losses and liabilities for both job seekers and recruiters.
Categories of Collection:
Job Seekers (Foreign Nationals): Including but not limited to identifying and characteristic data, such as name, nationality, age, highest education level, language proficiency, work experience, desired job category, desired job location, personal photo, and contactable phone numbers or communication software accounts.
Employers and Agencies: Including but not limited to company or institution name, name of person in charge or contact person, unified business number or permit number, company address, contact number, email address, and other information required for public contact and verification.
Article 3: Personal Data Guarantee and Responsibility for Proxy Posting
Although this Section agrees that employers or legal agencies may fill out forms and post resumes on behalf of foreign migrant workers, the proxy poster must declare to FWA and strictly abide by the following regulations:
Full Disclosure and Authorization: The proxy poster must clearly inform the data subject in a language they can understand that their personal data and photos will be publicly displayed in the FWA website section, and must have obtained the written or explicit consent of the data subject in accordance with the “Personal Data Protection Act” of the Republic of China. The proxy posting User must present the authorization proof document of the data subject to FWA.
Attribution of Responsibility: If the proxy posting User discloses the personal data of migrant workers without legal authorization, resulting in damage to the rights and interests of the data subject and triggering privacy infringement or labor-management disputes, the proxy posting User, such as the employer or institution posting on their behalf, shall bear full civil and criminal legal liabilities, and must compensate FWA for its reputation and all damages suffered as a result.
Article 4: Absolute Prohibition of Sensitive Data and Self-Protection Mechanism
Prohibition of Providing Sensitive Data: To protect personal privacy and prevent fraud, FWA strictly requires and explicitly stipulates that all posters “must not” fill in any sensitive personal data in the form that is not necessary for job seeking or recruitment. Such prohibited data includes, but is not limited to: full passport numbers, full Alien Resident Certificate (ARC) numbers, bank or financial institution account numbers, passwords, medical and health check records, fingerprints, or criminal records.
Right to Delete Directly: When FWA reviews or randomly checks the content of the forms, if it is found that a User has mistakenly or intentionally filled in the above-mentioned sensitive data, FWA has the right to mask or delete that part of the fields directly without notice, and even refuse the posting of the entire resume or job vacancy, to ensure information security.
Article 5: Period, Region, Target, and Method of Data Utilization
Period of Utilization: Valid for two months (60 days) starting from the date the data is approved and actually posted. Upon expiration of the posting period, or after FWA receives your request to take down the post, the FWA system will automatically remove the User’s resume or job vacancy information from the frontend webpage, and destroy the backend form data in accordance with regulations such as the Personal Data Protection Act of the Republic of China, without any form of retention or utilization.
Region of Utilization: Within the territory of the Republic of China, and regions globally where the FWA website can be legally accessed via the Internet.
Target and Method of Utilization: Resume or job vacancy data will be presented in the form of public webpage text and images in the FWA website section. The targets of utilization are any potential employers, legal agency companies, or general job seekers browsing the section, to facilitate direct contact and negotiation between both parties.
Article 6: Data Security Protection Measures
FWA promises to use reasonable technology and procedures to maintain the security of all personal data. The collected Google Form data and the website backend management system are equipped with a permission control mechanism, restricting access only to authorized internal FWA personnel within the scope of review, random check, and posting operations. FWA will not sell, exchange, or rent Users’ relevant personal data to any third-party for-profit institutions. FWA will only cooperate in providing relevant data when the following exceptions are met:
Cooperating with the legal investigations and execution orders of judicial authorities, prosecutorial and police units, or competent labor administrative authorities.
In order to protect the legal rights and interests of FWA, or when it is necessary for litigation because a User violates the “Terms of Service” and “Data Posting and Job Seeking/Recruitment Safety Covenant” of this Section.
Other circumstances where data must be provided externally in accordance with laws and regulations.
Article 7: Exercise of Rights by the Data Subject
In accordance with Article 3 of the “Personal Data Protection Act” of the Republic of China, Users may exercise the following rights at any time regarding the personal data held by FWA:
Inquire about, request to review, or request to make a copy.
Request to supplement or correct the posted content.
Request to stop the collection, processing, or utilization.
Request deletion (including but not limited to having found a suitable job or talent in advance and not wanting to continue exposure). Written requests can be submitted at any time through the FWA official customer service email ([email protected]).
Article 8: Amendment and Announcement of the Privacy Policy
In response to changes in the social environment, laws and regulations, or platform technology updates, FWA reserves the right to amend this Privacy Protection Policy at any time. When FWA makes major modifications to its policies on the collection, processing, and utilization of personal data, it will announce the updates prominently on the FWA website homepage or in this Section, without further individual notice.
